Terms of Service

These Terms of Service govern access to and use of BuyMyApp.buzz. By creating an account, publishing a listing, submitting an enquiry or offer, or otherwise using the service, the user agrees to these Terms and acknowledges the Privacy Policy and Marketplace Disclaimer.

Users who do not agree must not use the service.

Users must be at least 18 years old and legally capable of entering contracts.

Users must provide accurate account information, keep their login credentials secure and notify BuyMyApp promptly of suspected unauthorised access.

Each user is responsible for activity occurring through their account. Users must not impersonate another person, create deceptive accounts or use the service for unlawful purposes.

BuyMyApp provides technology that enables sellers to publish information about apps and digital businesses and enables prospective buyers to discover listings, make enquiries and express interest.

BuyMyApp is not the buyer, seller, owner, broker, agent, representative, partner or fiduciary of any user. A listing is supplied by its seller, not by BuyMyApp.

BuyMyApp does not independently guarantee or endorse any user, listing, claim, opportunity or transaction.

BuyMyApp does not receive, hold, control, transfer, disburse, refund or safeguard acquisition funds. BuyMyApp does not provide escrow, payment processing or settlement services for app acquisitions.

Buyers and sellers are solely responsible for agreeing on price, payment method, payment timing, escrow arrangements, refunds, taxes and transaction costs. Users should consider using qualified legal advisers and an independent regulated escrow or payment provider.

A seller publishing a listing confirms that:

• They own the app or digital business, or have documented authority to offer it
• Their listing is truthful, current and not misleading
• Financial, traffic, user and performance claims have a reasonable evidentiary basis
• They have the right to use all uploaded names, logos, screenshots, code descriptions and other content
• The proposed sale will not violate another agreement, licence, law or third-party right
• The listing does not contain malware, stolen code, unlawful material or intentionally concealed material defects
• They will promptly correct materially inaccurate information

Sellers remain solely responsible for their listings, disclosures and transaction obligations.

BuyMyApp may request evidence, label evidence as reviewed, reject, suspend or remove a listing where reasonably necessary to protect users, comply with law or enforce these Terms. “Evidence reviewed” means only that some supporting material was viewed; it is not an audit, certification, warranty or guarantee.

Buyers must independently investigate every proposed acquisition before committing funds or signing an agreement.

Due diligence should include, where relevant:

• Seller identity and authority
• Ownership of source code, branding, domains and intellectual property
• Revenue, expenses, profit and customer information
• Traffic, active-user and growth claims
• Code quality, dependencies, licences and technical debt
• Security, privacy and data-protection obligations
• Hosting and third-party service costs
• App-store, platform and vendor transfer restrictions
• Existing debts, disputes, refunds and contractual obligations
• Applicable taxes and laws

BuyMyApp does not perform this due diligence for users.

An enquiry, offer, counteroffer, acceptance status or message submitted through BuyMyApp is an expression of interest and negotiation record only.

Unless the buyer and seller separately execute a definitive written acquisition agreement, actions taken through BuyMyApp do not by themselves create a binding sale, transfer ownership or require payment.

Buyers and sellers are responsible for obtaining advice and documenting their final agreement independently.

Valuation results are automated estimates created from user-supplied information, deterministic calculations and AI-generated analysis.

They are provided for general marketplace guidance only. They are not certified valuations, professional opinions, promises of sale price, investment recommendations, or legal, financial, accounting or tax advice.

Actual value can differ materially. Users must verify input information and obtain independent professional advice where appropriate.

Users retain ownership of content they submit.

By uploading listing content, users grant BuyMyApp a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, format and display that content solely for operating, promoting and improving the marketplace.

The licence ends when the content is deleted, except for reasonable backups, legal records and material already shared outside the service.

Users must not upload confidential information that should not be publicly visible.

Users must not:

• Publish false, deceptive or materially incomplete listings
• Offer apps they do not own or control
• Infringe copyright, trade marks, privacy or other rights
• Distribute malware or malicious code
• Manipulate views, favourites, offers or evidence labels
• Scrape or overload the service
• Attempt unauthorised access
• Harass, threaten or defraud another user
• Use BuyMyApp for money laundering or unlawful transactions
• Circumvent security or impersonate BuyMyApp

BuyMyApp does not process the purchase price of listed apps.

If platform listing fees or optional service fees are introduced, the amount and applicable terms will be shown clearly before a user incurs a charge. No fee will be imposed merely by changing these Terms without a clear purchase or acceptance step.

BuyMyApp aims to provide a reliable service but does not promise uninterrupted or error-free availability.

Features may be improved, changed or discontinued for legitimate operational, security or legal reasons. Where a material change adversely affects users, reasonable notice will be provided where practicable.

BuyMyApp may suspend or terminate an account or listing where reasonably believed necessary because of fraud, illegality, security risk, serious or repeated breach, infringement, harm to other users or legal requirements.

Where appropriate and lawful, BuyMyApp will provide notice and a reasonable opportunity to respond.

Users may stop using the service and request account deletion by contacting mike@creeater.com. Some records may be retained where reasonably required for security, dispute prevention or legal compliance.

Buyers and sellers are responsible for resolving disputes between themselves.

BuyMyApp may, but is not required to, preserve relevant platform records, facilitate communication or respond to lawful requests. This does not make BuyMyApp a party to the dispute or transaction.

To the maximum extent permitted by law, the service and user-supplied listings are provided on an “as available” basis.

BuyMyApp does not warrant that a listing is accurate, that an app is safe or profitable, that a seller owns every claimed asset, that a buyer has funds, or that a transaction will proceed or succeed.

To the extent permitted by law, BuyMyApp is not responsible for indirect or consequential loss arising from user conduct, failed negotiations, payments made outside the platform, inaccurate listings, security defects in acquired apps, lost profits or third-party services.

Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.

Where liability for a service cannot lawfully be excluded but can be limited, BuyMyApp’s liability is limited, at its option and where legally permitted, to resupplying the affected service or paying the reasonable cost of having it resupplied.

To the extent permitted by law, a user is responsible for reasonably foreseeable loss suffered by BuyMyApp or another person resulting from that user’s unlawful conduct, material breach, infringement or fraudulent listing.

This provision does not require a user to compensate BuyMyApp for loss caused by BuyMyApp’s own negligence, unlawful conduct or breach.

The current version and effective date will always be displayed on this page.

Material changes will be communicated through the service or by email where reasonably practicable. Continued use after the effective date of revised Terms constitutes acceptance, subject to applicable law.

These Terms are governed by the laws of New South Wales, Australia. Subject to any mandatory rights or jurisdiction that cannot be excluded, disputes relating to these Terms are subject to the courts of New South Wales.
